2.0 Permitted Use. You may use the Software for the number of licenses or capabilities you have purchased. You may make copies of the Software and Documentation for your own use in accordance with the EULA and License Policy. All copies or partial copies of the software and documentation you create must include all patent, copyright and trademark notices. 6.0 Maintenance and support («Maintenance») of the Software is available in accordance with the License Policy and Support Policy available at www.veeam.com/support.html. Maintenance, if included in the purchased software, begins on the date your order is processed and the license file is generated. You will receive (a) support for your software and (b) any updates, enhancements or enhancements included or defined in the Maintenance Policy. If Customer decides not to obtain a license for the equivalent Commercial Software after the expiration of the Free Software Term, Customer will cease using such Free Software and remove it from its computer systems. 4.2 Collection of Information.

Licensed products may include features that automatically collect information about mapR software usage and configuration and the total capacity of your cluster and transmit that information to HPE. The Licensed Products do not access, collect, store or transmit personal data or business data files located in your IT environment as part of this feature. Licensed products only initiate outbound communication with HPE and do not listen to incoming communications. Licensed Products collect and transmit the above information by default. Unless otherwise specified in the applicable order, Customer has the option to configure the Licensed Products to disable the transmission of such information to HPE. HPE may use the information provided by the Licensed Products for activities such as determining usage for billing and license compliance purposes, and improving and marketing its product and service offerings. HPE may retain this information on a permanent basis. 2.1. License. Subject to the terms of this ALA, HPE hereby grants Customer a limited, non-exclusive, non-transferable, non-sublicensable license to internally install, reproduce, and use the Commercial Software on a maximum number of nodes specified in the applicable Order during the applicable license term specified in the Order. For the avoidance of doubt, Customer may not install or use the Commercial Software on a node that exceeds any of the Node Component Elements.

For the avoidance of doubt, the Customer may not grant third parties access to the Commercial Software or transfer the use of the Commercial Software, either autonomously or integrated into another Product, except with respect to external consultants and service providers who provide services to the Customer. 2.2. Record keeping. Customer shall maintain and maintain complete and accurate records of Customer, access to and use of the Commercial Software by Customer, its employees or agents, and any other information reasonably necessary for HPE to verify compliance with the terms of this ALA. MiscellaneousThe wording of these Terms of Use shall be construed as being of its fair value and not exclusively for or against any party. If any part of these Terms of Use is held to be invalid or unenforceable, that part shall be construed in accordance with applicable law and the remaining parts shall remain in full force and effect. To the extent that anything on or in connection with the Site conflicts or conflicts with these Terms of Use, these Terms of Use shall prevail. Aruba Networks` failure to enforce any provision of these Terms of Use shall not be deemed a waiver of that provision or the right to enforce that provision. Aruba Networks` rights under these Terms of Use shall survive termination. Restrictions on Software UseEvery use of the software and accompanying documentation that you download from the Site is subject to the terms of a software license agreement between you and Aruba Networks.

You must read the license agreement and indicate your acceptance of its terms before installing or using the software. All right, title and interest not expressly granted are reserved. 11.0 Intellectual Property Rights. All right, title and interest in and to the intellectual property rights in and to any copies you may make are owned by Veeam and/or its licensors and are protected by patents, copyrights, trade secrets and other international laws and treaties in Switzerland, in the United States and other countries. These licensors, in addition to any other rights or remedies available to them, are third party beneficiaries of this EULA for their respective software. This software is LICENSED, NOT SOLD. The purchase of the software license (perpetual or subscription) is not returnable or refundable. The Software is protected by patents, and certain trademarks and logos used in the Software are protected by trademarks. 1.1. «Commercial Software» means software identified in an Order (either by HPE or by an Authorized HPE/MapR Partner) and licensed for a fee, e.B MapR Enterprise Edition or MapR Enterprise Database Edition, if licensed for a fee. HPE may authorize Customer to convert a copy of free Software to Commercial Software by entering or installing a license key for Commercial Software purchased by Customer. .
