Walkway Agreement

(c)the attachment or retention of anything (including a structure or protrusion) inside, on or above that walkway. (b)the lighting of that walkway and of the part of the building or structure that will be above or above it; (13) Without prejudice to paragraph 11 above, the provisions of this section may contain different provisions for different classes of footbridges and may contain ancillary, additional and consequential provisions (and in particular provisions on carriageways provided for on the basis of agreements entered into before the coming into force of the Regulations) that the Minister considers appropriate for the purposes of the Regulations. (12) The provisions of this Article do not exclude the rights of legal funeral directors, F6 . . . [F7F6. . . . . or operators of [F5 electronic communication code networks] to place and maintain equipment in, under, along or over a part of a gateway that is not supported by any structure. 5. An agreement contained in an agreement under this Section and entered into by a person who has an interest in a country affected by the agreement is a local base fee.

2. An agreement under this Division is an agreement with any person who has an interest in a parcel of land on which a building is situated or is to be situated, a person who, by virtue of that interest, has the necessary authority to do so. (e)payment of payments by the authority concluding the agreement or, where the agreement is concluded jointly by a district council [F1non-metropolitan] and a local motorway authority, one of those authorities vis-à-vis a person who has an interest in the land or building concerned by the agreement; (b)amend, amend or adapt such a decree or instrument in its application to such gateways; (b)for the dedication of those trails as walking trails by that person, which may be subject to restrictions and conditions that affect the public right of way over it, as set out in the agreement, and for all rights reserved by the agreement of that person and any person who gives ownership of the land under his or her property. (a)prevent the application of decrees or instruments relating to motorways or objects committed on or in connection with motorways, to carriageways created or to be created pursuant to agreements under this Section, or to things committed on or in connection with such carriageways; (f)termination of the public`s right to use that gateway in a manner and subject to the conditions set out in the agreement; (d)without prejudice to the foregoing, determine the circumstances and modalities of regular or temporary closure or shutdown of such footbridges and determine the procedure to be followed before stopping that carriageway. (d)the authority concluding the agreement or, where the agreement is concluded jointly by a district council [F1non-metropolitan] and a local road traffic authority, authorises one of those authorities to enter any building or structure in which such a footbridge will be located and to carry out all the work necessary to ensure the performance of an obligation that a person is required to fulfil at the moment under the agreement; or subsection (4) below; (c)without prejudice to the generality of points (a) and (b) for the exclusion, limitation or regulation of the rights of statutory funeral undertakings, F3. . . . . . . . . and operators of [F5 electronic communication code networks] to place and maintain equipment in, under, above, along or above such gateways; (4) Any agreement (whether positive or restrictive) contained in an agreement under this Section and entered into by a person who has an interest in a country affected by the Agreement shall be binding on the persons who derive ownership thereof under the Federation to the same extent as it is binding on the Federation: notwithstanding the fact that it would not have been binding on such persons other than the provisions of this Subsection and that it is enforceable against such persons by the local road traffic authority. A walking trail established in accordance with an agreement under this section is hereinafter referred to as a «footbridge». 6.

Where an agreement has been concluded in accordance with this Section, the competent authority may adopt statutes governing: (b) the hours at which such a footbridge may be closed to the public; 8. Not later than 2 months before an authority proposes to enact a law in accordance with subsection (6), it must indicate its intention to adopt those laws in a clearly visible position on or off the roadway concerned. (14) Nothing in this Division shall be construed as affecting any other provision of this Act or any other order on the basis of which highways may be established. (10) The Minister of the Crown, empowered under section 236 of the M1Local Government Act 1972 to confirm a statute made under subsection (6), may confirm the statutes, with or without amendments; and if it proposes to confirm them by means of amendments, it may, before confirming them, instruct the authority by which they were made to inform those persons of the proposed changes, in a manner which may be specified in the direction. However, in the cases referred to in paragraph (c), the local road traffic authority shall consult the district council before adopting a statute and, in exercising its power of confirmation, the Minister shall take into account any dispute between the local road traffic authority and the district council. 11. Subject to paragraph 12 below, the Minister may, after consulting the representative organisations he considers appropriate, adopt provisions: 9.In a communication referred to in paragraph 8, the place where a copy of the proposed statutes may be consulted and the period which may not be less than 6 weeks from the date on which the notice was first affixed as indicated above shall be: indicate; within which assurances may be given to the Authority and the Authority shall review all assurances it has received during that period. .
